General Terms of Use for ProductionNews.com
§ 1
The Terms of Business are valid for all legal matters,
that Productionnews.com engages in with businesses and agencies (hereforth called "Client") as it pertains to use of their internet platform. In case of extreme changes, the Client has the right to end his/her user contract.

§ 2
Business matters of Productionnews.com is the digital distribution of press releases, pictures and graphics. Productionnews.com uses for these purposes online databanks as a means of distribution for texts, that are provided by the clients.
ProdutionNews.com reserves the right to shorten or change the information supplied by the Client.
Verantwortlich für den Inhalt der zu verbreitenden Informationen ist der Kunde (Nachrichtengeber). The Client (News Supplier) is responsible for the content of the information to be distributed. Material submitted should be without third-party rights. Eventual limitations of use are to be submitted in written form by the Client when the contract is assigned. ProductionNews.com takes no responsibility for adhering to the these limitations of use by the recipient of this information.
The Client releases ProductionNews.com from any demands by a third party, and will take responsibility for any costs or debts including costs for legal representation again claims of a third party.
ProductionNews.com reserves the right not to distribute material under special circumstances, especially if it is obvious that these improperly violate rights and/or morals or are deemed uninteresting.

§ 3
Information distributed in contract with the Client by ProductionNews.com is accessible for anyone. A limitation of access for individual or legal purposes is not allowed.
ProductionNews.com has no influence on whether or not Information provided as a result of the services offered are received and edited by an individual. ProductionNews.com is excluded from any responsibility regarding this.
ProductionNews.com is not obligated to prevent users from further distributing Material.

§ 4
Following the request of the Client, messages can be distributed and/or translated and distributed in German, English and/or Chinese. Productionnews.com momentarily offers translation into English and Chinese free of cost. ProductionNews.com is however not obligated to translate information into English and has the right, to deny contracts for translation in Chinese.
In translations done in contract with the Client, ProductionNews.com only takes responsibility for negligence with obvious fault.

§ 5
As a basic principle ProductionNews.com tries to distribute messages as quickly as possible. For time delays or editing mistakes ProductionNews.com takes no responsibility unless the minimum proof of negligence is provided.
As soon as the Client submits information for distribution to ProductionNews.com via a password secured web portal, the Client is solely responsible for the secrecy of user names and passwords provided. The Client takes all responsibility from ProductionNews.com for all debts incurred through unauthorized use of secured access by third parties after this data has been provided to the Client by ProductionNews.com

§ 6
ProductionNews.com does not take responsibility under any of the following circumstances:

ProductionNews.com reserves the right to change office hours and corresponding changes at any time.
ProductionNews.com tries to optimize its internet performance according to current technical standards and therefore older technology can only receive limited support.

§ 8
The current ProductionNews.com price list is valid for services that incur charges.

§ 9
The Client guarantees that only details relevant to the matter at hand will be published in job advertisements. The Client guarantees in connection to this, not to publish content that is illegal, immoral or misuseful. Considered misuseful are all contents, that are not conducive to a concrete service or work-relationship.
The Client is responsible for formulating job offers, so that they meet requirements of German and International anti-discrimination laws. If the Client violates this requirement, then Client is responsible for all costs and consequences for an eventual legal suit by a third party. A damage claim due to the publishing of non-proper content as seen by the law, if these were supplied in this form by the Client, is not allowe.  

§ 10
ProductionNews.com does not take responsibility for contents that were made published or available, from third parties, including clients, partners and users.
ProductionNews.com does not tolerate use of its Internet platform for the distribution of false or illegal Information (be it based on German or International Law). Responsible for this are the individuals or legal entities, who use the server or Storage medium of ProductionNews.com for the purpose of storing and/or distributing such material, not ProductionNews.com.
ProductionNews.com reserves the right to deny or delete content and/or material from its databank. This is especially valid when content/material violates legal or official bans or morals. This is also valid if the distribution is for special reasons unacceptable for ProductionNews.com.
ProductionNews.com reserves the right to continue deleting these Contents from the ProductionNews.com internet site without prior warning to the contractor. The contractor will be informed of such an action. A right to demand reimbursement is not justified.
ProductionNews.com does not take responsibility for contents on external sites, mentioned within the framework of its internet platform.

§ 11
Oral agreements are only valid when they are confirmed in writing.

§ 12
ProductionNews.com reserves the right to change the Terms of Business at any time. The amended Terms of Business are then valid for all contract relations entered into after the changed date.
ProductionNews.com has the right, to change its Terms of Business, also if this has effects on current continuing obligations. In this case the Client has two weeks to object to the changed Terms of Business.
In the case of an objection, ProductionNews.com has the right to cancel the contract within two weeks following the submission of the objection.

§ 13
Part of this regulation being null and void, does not mean that the entire regulation is null and void. The parts of the regulation which are most conducive to the economic purposes of the parties, holds more validity.

§ 14
German laws apply. Legal jurisdiction and place of execution is Berlin.
